Return Policy

Valued customer, we thank you for your purchase and hope you are satisfied. However, if you are not completely satisfied with your purchase for any reason, you may return it to us for store credit OR a full refund. Please read the following for more detailed information regarding our return policy.

Returns

All returns must be postmarked within 30 days of the purchase date. All returned items must be new and unused. They must have all original tags and labels attached to be considered for a return.

To return an item, please email our customer service team at customer.service@plaxoadaptive.com. They will authorize your return and give you a Return Merchandise Authorization (RMA) number, mailing address and return forms. Upon receiving this confirmation and number, please place your item securely in its original packaging with its proof of purchase and return forms.

Refunds

After receiving your return and inspecting the condition of your item, we will process your return/exchange/refund. Please allow 30 days from the receipt of your item to process your return/exchange/refund. Refunds may take 1-2 billing cycles to appear on your credit card statement. We will notify you when your return has been processed.

Plaxo Adaptive Terms of Use

The following terms and conditions of use (“Terms”) govern Plaxo Adaptive LLC’s (“Plaxo Adaptive”) website located at www.plaxoadaptive.com (“Site”), owned and operated by Plaxo Adaptive LLC. The content and products on our website and social media sites are referred to herein as (“Services”). By accessing, viewing, or using the content, material, products, or services available on or through the Site, you certify that you have read, understand, and agree to be legally bound by these Terms, as well as our Privacy Policy, each of which is incorporated by reference as if fully set forth herein. Plaxo Adaptive reserves the right to make changes to the Site and to these Terms from time to time. Please review these Terms whenever you use our Site because by visiting the Site, you agree to accept any such changes.

1. Purchases

By purchasing products through the Site, you represent that you have reached the age of majority in your state and have the legal capacity to enter into a contract. If you are under the age of majority or cannot lawfully enter into a contract, you must have your parent or guardian review these Terms and the Privacy Policy, and register or place an order on your behalf. Plaxo Adaptive may use a third party payment processor to process credit card transactions made through the Site. You are also responsible for paying any governmental taxes imposed in connection with use of the Site or the purchase or any products or services made available through the Site, including sales, use, and excise taxes (excluding only taxes on Plaxo Adaptive’s net income). To the extent that Plaxo Adaptive is obligated to collect such taxes, the applicable tax will be added to your billing account. All sales are subject to our shipping and return policies, which shall be made available to you on the Site or other delivered to you with your purchased goods.

2. E-Mail Subscription

You’ll be able to subscribe to our mailing list to receive emails and updates from the Services by providing us with your email address. You can unsubscribe at any time.

3. Errors, Inaccuracies, and Omissions

We do not warrant that all Product descriptions, photographs, pricing, and other information are accurate, complete, reliable, current, or error-free. In the event of an error, whether on the Services, in an order confirmation, in processing an order or delivering a Product, we reserve the right to correct such error and revise your order accordingly or to cancel the order and refund any amount charged.

When you place an order, we will ship your order to the address you designate as your shipping address. We reserve the right, without prior notice, to limit the order quantity on any product or service and/or to refuse service to any customer.

5. Trademarks

Plaxo Adaptive’s trademarks and logos (“Marks”), whether registered or unregistered, that appear in connection with the Services and products and on the Site are owned by Plaxo Adaptive. You may not copy, display, or reproduce Plaxo Adaptive’s Marks.

6. Copyrights

All content on this website, including the selection and arrangement of that content is owned by Plaxo Adaptive and is protected by copyright and may not be used without the express written consent of Plaxo Adaptive. The Content includes text, images, graphics, logos, audio and video clips, software, and digital downloads.

7. License and Site Access

Plaxo Adaptive hereby grants you a limited non-exclusive, non-transferable, license to use the Site and Services. You many not download any portion of the Site or use and of the Services other than for your own personal use.

8. No Endorsement and Third Party Links

From time to time, the Site may contain links to other websites that are not owned, operated or controlled by Plaxo Adaptive. All such links are provided solely as a convenience to you. If you use these links, Plaxo Adaptive cannot be responsible for any content, materials, information or events that are present on or that occur on websites that are not owned, operated or controlled by Plaxo Adaptive.

9. Warranties and Disclaimers

The Service, Site, and all products and services delivered to you through the Service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including without limitation, warranties or conditions of merchantable quality, merchantability, durability, fitness for a particular purpose, title, non-infringement, freedom from errors, omissions, computer viruses or other malicious or unauthorized code or programs, and implied warranties or conditions arising from course of dealing or course of performance.

We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.

In no case shall Plaxo Adaptive, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service, Site, or any products procured using the service, or for any other claim related in any way to your use of the Service, Site, or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

IN NO EVENT WILL PLAXO ADAPTIVE BE LIABLE FOR DAMAGES OTHER THAN ACTUAL AND DIRECT DAMAGES PROVEN IN A COURT OF LAW. IN NO EVENT SHALL PLAXO ADAPTIVE’S LIABILITY EXCEED THE PRICE YOU PAID FOR THE PRODUCT OR SERVICE THAT IS THE SUBJECT OF THE CLAIM.

11. California End-User Consumer Rights

12. Miscellaneous

These Terms constitute the entire agreement between you and Plaxo Adaptive with respect to the Site and Services, and they supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and Plaxo Adaptive. The failure of Plaxo Adaptive to exercise or enforce any right or provision of these Terms will not operate as a waiver of such right or provision. If any provision or part of a provision of these Terms is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.

California Consumer Privacy Rights

If you are a California resident, the following information is with respect to our collection, use, and disclosure of personal data pursuant to the California Consumer Privacy Act (“CCPA”). If you are a California resident, you can make certain requests regarding your personal information, which we will fulfill to the extent required by law.

Information Collected: In the preceding 12 months, we have collected the following categories of personal data: identifiers, characteristics of protected classifications under California or U.S. law, commercial information, internet and electronic network activity, geolocation data, inferences drawn about your preferences, and other categories of personal data that relates to or is reasonably capable of being associated with you.

Use of Personal Information: We collect personal data for the following business purposes: (i) to fulfill or meet the reason you provided the information (i.e., to respond to your inquiry or to process your payment and facilitate delivery); (ii) to support and develop our Site and Services; (iii) to maintain your account with us; (iv) to process requests, purchases, transactions, and payments; (v) to personalize your experience and deliver content relevant to your interests; (vi) to maintain the security of the Site and Services; to respond to law enforcement, government, or court order requests; (vii) as described to you when collecting your personal information or as otherwise set forth in the CCPA; and (viii) to evaluate or conduct a business transaction involving the sale of all or a portion of our assets.

Sale of Personal Data: Plaxo Adaptive does not sell your personal data.

Request Regarding Personal Information: California residents have the right to request access to their personal data, additional details about our information practices and deletion of their personal data. California residents have the right to opt out of sales of personal data, if applicable. California residents may request access to the specific pieces of personal data we have collected about you in the last 12 months. You may also request additional details about our information practices, including the categories of personal data we have collected about you, the sources of such collection, the categories of personal data we share for a business or commercial purpose, and the categories of third parties with whom we share your personal data.

Request to Delete Personal Information: You may request that we delete the personal data we have collected about you. Once we receive a request, we will delete the personal information (to the extent required by law) we hold about you as of the date of your request from our records and direct any service providers to do the same. In some cases, deletion may be accomplished through de-identification of the information. If you choose to delete your personal information,

you may not be able to use certain website or in-store functions that require your personal information to operate. Deleting your personal information will not cancel memberships you have purchased.

California “Shine the Light” Policy: California Civil Code Section 1798.83 permits customers who are California residents to request certain information regarding its disclosure of personally identifiable information to third parties for their direct marketing purposes. However, at this time we do not share any of your personally identifiable information with third parties for their direct marketing purposes.

To submit a request regarding your personal information or a request to delete personal information, please send the request via e-mail to customerservice@plaxoadaptive.com. After submitting your request, please monitor your email for a verification email. We are required by law to verify your identity prior to granting access to your data in order to protect your privacy and security.
